This Women’s History Month, the Equal Rights Amendment Is Unfinished Business

As we celebrate Women's History Month this March, an unprecedented number of women now hold public office, and an unprecedented number of viable women candidates are running for president. For decades, feminists have been dismissed with arguments that we're already living in a "post-sexism society." Could it be that, in 2019, that argument rings true?
On a very surface level, it might look like our gender problems are fixed - or on the road to being fixed. But look closer, and institutionalized, sexist oppression, gendered violence, and workplace discrimination remains pervasive and everywhere. And this month especially, we all need to remember the Equal Rights Amendment still has yet to pass. The ERA, a proposed Constitutional amendment that would afford women equal legal rights and status to men, was introduced to Congress almost a century ago. Eighty-percent of respondents to one 2016 survey erroneously believed men and women already have equal rights under the Constitution. That's untrue - and exactly what the ERA was written to address.
Policies from the Trump administration - and many state governments emboldened by that administration - to see how society is harming women or pushing them out of public life by denying them life-saving reproductive health care and protecting sexual abusers. If anything, the ERA is just as necessary as it was when it was first introduced.
How the ERA Was Born
Originally written by the famous suffragettes Alice Paul and Crystal Eastman, the ERA was first introduced to Congress in 1921. After languishing for decades, it gained massive traction in the 1970s, and its ratification once seemed like a certainty. But in the face of a heated, highly effective resistance led by conservative women, the amendment ultimately failed to be ratified by a majority (38) of states before expiring. Despite that, state legislatures are still considering and voting on the ERA, and as of last summer, Illinois became the 37th state to ratify the ERA. (The Florida, Arizona, North Carolina, South Carolina and Georgia state legislatures are all currently considering bills to ratify the ERA.)

In the 1970s, the United States saw landmark victories for women's rights, including the right of single women to legally access birth control in 1972, and the right to access safe, legal abortion in 1973. But despite coming close, the ERA was ultimately blocked by a salient, well-organized opposition movement, which relied on fear-mongering and gendered hypotheticals to persuade the American public. Conservative activist Phyllis Schlafly became the leader and face of the opposition, asserting the ERA would cause American women to be drafted to wars, lose "protective legislation" that accorded them safer working conditions than male laborers, and be forced away from their children and households.
Schlafly, a lawyer and housewife from Illinois, founded the Stop ERA group and led what's become known as one of the first grassroots conservative movements in the US Schlafly started by distributing pamphlets in the street, and publishing op-eds in local newspapers. Some of her op-eds included such choice lines as, "Women's libbers are promoting free sex instead of the 'slavery of marriage,'" and "They [feminists] are promoting Federal 'day-care centers' for babies instead of homes . . . abortions instead of families."

Schlafly's primary arguments were and are pretty easily debunked: Most feminists and ERA supporters oppose the draft for men and women; support fair and safe labor policies for male and female laborers; and support women making fully autonomous decisions in domestic life and child-rearing. But the gist of her argument - that the ERA would endanger women by necessitating sweepingly equal treatment of men and women - remains salient and controversial to this day.
Where's the Debate?
At the core of these historical and persistent arguments against the ERA is a debate over equality and equity: whether we should apply sweepingly equal treatment to people with vastly different experiences and needs, or simply accord people equal status and legal rights, while acknowledging differences in those experiences and needs.
For example, demanding equal treatment of women and men could be actively harmful to women, if it meant eliminating women's empowerment programs and scholarships or diversity standards meant to uplift and recruit women into fields where they are underrepresented. In the absence of such programs, which recognize the inherent place of disadvantage women come from in male-dominated fields, we build upon and expand existing inequality. But the ERA would crucially recognize American citizens as having equal status and legal rights regardless of gender, rather than mandate indiscriminate, equal treatment of men and women.
Why We Need the ERA Today
It's critical that we finally codify the equality of the sexes into the law of the land, and ensure our laws reflect today's increasingly - albeit strained - egalitarian culture through the ratification of the Equal Rights Amendment. The ERA could play a role in nearly every modern women's rights struggle, from the mounting war on reproductive rights and endemic sexual violence, to safety and equal pay and opportunity in the workforce.
Specifically, as legal advocates for the ERA have argued, the amendment could protect women from pregnancy and motherhood discrimination, guarantee equal pay, and formally recognize sexual assault and rape as sex discrimination. Lenora Lapidus, director of the Women's Right's Project at the ACLU, told Cosmopolitan: "The ERA would make it clear once and for all there can be no discrimination on the basis of sex. There can be no differential treatment of individuals based on their gender."
In recent years, access to reproductive health care has been steadily eroded to the extent that millennial women's living standards in the context of maternal health and maternal death rates are substantially worse off than their mothers'. Ninety percent of US counties lack abortion providers due to an influx of discriminatory laws enacted in the last decade. Since Roe v. Wade, 1,200 laws targeting women's right to abortion access have been enacted, and more than a third of these laws were passed between 2011 and 2018 alone.
The Equal Rights Amendment could be critical to reasserting women's equal right to safety and full reproductive decision-making power in their bodies, especially in the event that Roe is dismantled or reversed in the coming years. By granting women equal status and legal rights, the ERA could be used to grant women the same right to privacy and bodily autonomy that male citizens have.
Similarly, sexual assault rates remain high, targeting an estimated one in five women, while non-reporting rates stand between about 65 to 85 percent. Sexual harassment and misconduct remain prevalent in workplaces, forcing women out of jobs, industries, education, and public life. The ERA could play a critical role in supporting the rights of survivors, and protecting the safety and inclusion of women in public spaces - including offices, by asserting their equal legal right to safe, nonviolent workplaces. The amendment could also be central to combating the gender wage gap and protecting equitable options and opportunities, by requiring equal compensation for equal work, and formally recognizing the gender wage gap as discrimination.
Where Does the ERA Stand, Today?
Democratic presidential candidate Kamala Harris stated explicitly last month that fighting for the ratification of the ERA would be a priority of her presidential administration. Harris is one of several leading Democratic lawmakers and feminist activists who have publicly shifted attention and public pressure back to the amendment.

Now that we're just one state away from the 38 state requirement for ratification, the ERA is a very real possibility. There is, of course, one caveat: The deadline for the amendment to be ratified by 38 states was 1982 - almost 40 years ago. At the end of 1982, only 35 states had ratified the amendment. Upon being ratified by 38 states, the validity of the ERA would likely face legal challenges because of this deadline.
A Democratic-controlled House of Representatives could bode well for passing legislation to ratify or establish a new deadline for the amendment in the future, which should underscore the critical nature of voting. And as the ERA Coalition has stated in response to Harris's declared support for the amendment, it's crucial that up and down the ballot, candidates express support for the ERA, and a determination to fight for its ratification.
As we celebrate Women's History Month, the Equal Rights Amendment is a central part of women's history, as it remains a piece of unfinished business within our lifetime. The ERA has the potential to fundamentally protect and expand women's rights, and promote tremendously important cultural shifts. And the amendment is entirely attainable if we remember and fight for it.

Before I created LipSlut, I really didn't know what I wanted to do with my life. I was a third-year in college at Cal Poly, San Luis Obispo, studying graphic communications, but I didn't know where my major was going to take me.
I was sitting on the floor of my dorm room watching Trump's inauguration, and I knew I had to do something about it. I've always been really interested in makeup and beauty, but there weren't many brands out there that I knew about willing to take a firm stance on social issues or that I felt were genuine, so that was the first thing that came to mind: create a brand that lets you give back to an organization you care about. This was a chance to combine the two to make activism more accessible to everyone.

Sure, Glossier Play's New Glitter Gelée Is Pretty, but Is It Easy to Use?
Among the seemingly endless scroll of memes and videos of kittens doing kitten things, you'd find a folder of makeup inspiration in the "Saved" tab of my Instagram. Of those photos, you'd see glitter cat eyes that I swore I'd try . . . someday.
That day came today, when I got my hands on the Glitter Gelée and Detailer($16), a pair by Glossier's sister brand, Glossier Play. To create my sparkling wings, I first drew in my typical ones with a black, inky eyeliner pen. Then, I dipped the silicone tool into the pot of sparkling goop. The Gelée had a bouncy texture and was easy to scoop with the spatula. I then used short strokes to sweep the gel across the wings I'd drawn on.
I found that the combination of the silicone angled tip and the Gelée's texture - which was not sticky but clung onto the areas in which it was applied - allowed me to maneuver the flecks of foil exactly where I wanted them. I Ignored This Simple iPhone Message All the Time, and It Cost Me 4+ Hours in the Store
A few weeks ago, my husband and I ventured to our nearby phone store to get new iPhones. We were due for an upgrade and were both easily sold on the iPhone X - me for the amazing camera capabilities, and my husband for game storage. But while his transition from his old phone to a new one only took about 20 minutes, mine took over four hours. Why? Because I never backed up my phone. Ever. And they couldn't transfer all of my data from my old phone to my new one without it being backed up.
Throughout my years as an iPhone user, I've gotten pretty used to ignoring one particularly annoying message that popped up frequently: "iPhone Not Backed Up." I always hit "OK" and forgot about it because it was something I didn't want to deal with or thought I didn't need to do. And the few times I did try to back up my phone, it gave me an error message, so I just stopped trying.
Well, fast-forward to the very annoyed saleswoman who knew she would have to sit there for four hours while my phone backed itself up from who knows how long, and I knew I made a mistake. And the worst part about it is that it's such an easy fix! To make sure you don't continually get that annoying message and ensure your phone backs itself up automatically and frequently, all you have to do is click a button.
Go into Settings, click on your name at the top, and click on "iCloud." Scroll down to "iCloud Backup" and turn it on. Turning this on will have your phone automatically back up data such as your photo library, documents, accounts, etc., when your phone is connected to a power source, locked, and connected to WiFi. And that's it. It's that simple! If I had just turned that on a long time ago, I would have been out of the store in 20 minutes, but instead I sat there for four hours on a Saturday. So, please learn from my silly mistake.
Can People Tell When You Look at Their Instagram? We Have Good and Bad News
One of the best things about Instagram is having the ability to anonymously and innocently stalk people - old boyfriends, friends, weird family members, potential dates, etc. If their profiles are public, you can scroll through their grids, check out their photos, and pray you don't accidentally double tap. But have you ever wondered if the people you're creeping on can tell you've been lingering on their page? Or how sometimes the people you look at and don't follow still tend to show up more in your feed? Well, we have good news. Nobody can see when or how often you look at their Instagram page or photos. The bad news? People can see who views their Instagram stories and videos.
Julian Gutman, product lead for Instagram Home, recently explained how Instagram's feed and stories work and how certain things show up. "The people that show up on that list are not the people that stalk you the most," he told The Verge. "It's actually based on your activity and the people that you're closest to." He added that if you look to see who's viewed your story multiple times, you may notice new names popping up higher in the feed, and that's simply because Instagram wants to show you new data from the last time you checked. So it has nothing to do with who's stalking you, but who you're stalking.
Unfortunately, Instagram is super tight-lipped about its algorithms and how exactly they figure out what shows up for you. But according to TechCrunch, what shows up in your feed is all about how you interact with the accounts you follow. The three main things include your interest (how much Instagram thinks you'll care about a post based on your past behavior), recency (how recently a post was shared), and relationship (how close you are to the person based on your commenting, being tagged in their posts, etc.).
So, if you're hoping to stay incognito, don't watch someone's Instagram stories or posted videos (any video they post to their page, including Boomerangs). And an FYI, according to Instagram, a view is counted if a video is played for three seconds or more.

How 2 Women Turned a Group Chat Into a Career Hub For Media Professionals of Color
In 2016, Bianca Jeanty and Netta Dobbins started a group chat as a way to satisfy their mutual desire to connect with marginalized young professionals in the media industry. It was never supposed to turn into an actual business - until it did.
"In less than a week of its creation, we had over 300 people in the chat talking about their experiences in the media industry," Dobbins told POPSUGAR via email. "Topics ranged from people getting their foot in the door at companies [to] them being continually looked over for promotions and being tokened as some of the only people of color in the office."
For Jeanty and Dobbins, who both work in New York City in ad sales and public relations, respectively, the chat's rapid growth - paired, of course, with the lack of diversity in the industry - signaled that they had something bigger on their hands. "This was the moment we knew there was a real problem in the industry and set out to establish what Mimconnect was," Dobbins added.
Three years later and that group chat, now a company known as Minorities in Media Connect (Mimconnect), has transformed into a trusted career-building resource for over 4,000 job seekers and others simply looking to network. It's a huge feat, yes, but getting there wasn't a walk in the park. "We didn't realize how difficult it was until we were neck-deep into building the company," Dobbins said. "Like we said before, we never planned to make Mimconnect an actual business. It just happened. And with that we had so many people leveraging Mimconnect to build relationships and collaborate with one another that we couldn't just stop and fade into the background."
An assemblage of journalists, publicists, graphic designers, advertisers, and more, Mimconnect provides media professionals in New York, Atlanta, Los Angeles, Washington, D.C., and San Francisco with a network to discuss company culture, job-hunting strategies, and happenings in pop culture and the media industry. On the employer front, Mimconnect is launching their beta platform in March that allows companies to promote their latest openings, while finding leads through the group's candidate directory. Though they don't discourage anyone from seeking membership, a good amount of Mimconnect's focus appears to be on the career trajectory of mid-level professionals.
Because less than a quarter of the media industry is composed of people of color, there's a disparity when it comes to building that network.
"As you grow and mature in your career, you begin to get opportunities based on who you know and the professional network you've built," Dobbins explained. "Because less than a quarter of the media industry is composed of people of color, there's a disparity when it comes to building that network. When you're fresh out of college, you have all of these resources at your disposal to get internships or entry-level jobs. But what happens when you become mid- or senior-level? The developmental resources at the Manager and Director level are limited."
To strengthen those resources, Mimconnect hosts digital and in-person events at least once a month in addition to producing their own career advice-focused content online. Their advice to young people of color finding it difficult to navigate and build relationships in their predominately white work spaces is simple: stay true to who you are.
"Sometimes when we're uncomfortable in a space, we'll quickly conform to whatever that space normalizes . . . like being forced to talk about The Bachelor when you have never seen the show and you don't even enjoy it," Dobbins said. "Realize that by bringing your whole self to work day in and day out, you bring a perspective that no one else has."
Jeanty added, "There's a narrative about not making friends in the workplace, but I strongly believe in finding your champion that you can feel safe with and someone who will serve as a contextual soundboard. Your external support reminds you of your 'why' and the mission you've set out to complete."

Having a Destination Wedding? Here's How to Make Your Marriage Legal in the US
Whether you're saying "I do" in the Italian hills of Tuscany or on a beautifully sandy beach on a Caribbean island, destination weddings have the ability to add a bit more magic to an already special day. However, tying the knot outside of the US adds another layer of complication, and it's important when planning to not forget some of the details. One big one? Making your marriage legal at home before or after getting married abroad.
POPSUGAR spoke to David Reischer, Esq., attorney and CEO of LegalAdvice.com, to get his expert advice on the subject. "It's extremely complicated and not practical to get married in a foreign country and to then try to get the foreign marriage validated in the United States," explained Reischer. Thankfully, there are a few simple alternatives that couples can choose from that can make the whole process much easier. For instance, Reischer suggested couples get legally married in a US court house either before or after their destination wedding. "A couple can make their destination wedding legal at home by getting married again in the United States upon return from abroad," he continued. "The couple can also get married in the United States before the destination wedding."
However, Reischer acknowledged that the obvious disadvantage of a couple legally tying the knot before their destination wedding may be that they'll feel like they're jeopardizing the romantic aspect of their big ceremony. If you're worried about this, he advised getting legally married when you return from your destination wedding.
"Many couples decide to go to the county clerk and remarry once returning to the United States from their destination wedding," he said. "All a couple has to do is get a marriage license from the county clerk, then go to city hall or hire a legal official who is allowed to perform legal ceremonies in the city where the couple reside." By deciding on legalizing their marriage this way, couples will not have to translate foreign paperwork and there will be no need for blood tests in a foreign country. "It's extremely less complicated and cheaper to get married for a second time upon returning from a destination wedding and this is what most people do," Reischer said.
